Welcome to ThinkAsia, an online platform administered by the Asian Development Bank Institute (ADBI) with participating institutions, representing think tanks and international organizations from around the region and globally. It serves as a free and open-access tool designed to promote knowledge products on development policies. Please carefully read the following terms and conditions ("Terms of Use") before using ThinkAsia. By accessing or using ThinkAsia, users and registered community partners agree to be bound by these Terms of Use.

1. Acceptance of Terms

By accessing or using ThinkAsia, you acknowledge that you have read, understood, and agree to comply with these Terms of Use. If you do not consent to these terms, kindly refrain from utilizing this platform.

2. Use of ThinkAsia

2.1 Content Browsing: ThinkAsia allows users to browse content from ADBI and our partner institutions. All content is displayed with permission from the original sources.

2.2 User Registration: Users have the option to create an account on ThinkAsia. By registering, you agree to provide accurate, current, and complete information during the registration process. You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer.

3. User Profile and Community Partner Content Posting

3.1 User Profile: Registered users will have a user profile, where they can provide additional details such as career experience, educational background, gender, affiliation, and other optional information.

3.2 Content Types: Registered community partners can post various content types, including publications, events, career opportunities, media, and e-learning materials.

3.3 Responsibility for Content: Community partners are solely responsible for the content posted on ThinkAsia. By posting content, community partners represent and warrant they have the necessary rights and permissions to share the content. ThinkAsia/ADBI is not responsible for any content posted by any third party. Content posted by ADBI on ThinkAsia is not part of any user guide or legal agreement. All such aforementioned content is provided “as ­is”, and ADBI do not make any representation as to its quality or accuracy, and specifically disclaim the accuracy, completeness, reliability, usefulness, non­infringement, quality, or originality of such content. ADBI disclaim any responsibility whatsoever for any content or material in the platform regardless of who originated that content (including our employees, partners, affiliates, or moderators).

A registered user shall not impersonate any other person; falsely say or imply association with ADBI, another person or entity; submit content in exchange for payment or other consideration from another person or entity; use ThinkAsia in connection with unsolicited commercial messages; violate any antispam or similar law; use ThinkAsia to store or transmit infringing, libelous, or otherwise unlawful or tortious material, or to store or transmit material in violation of third party privacy rights; use ThinkAsia to store or transmit malicious code or malware, or to engage in phishing or other fraudulent activity; interfere with or disrupt the integrity or performance of ThinkAsia or any data contained therein; attempt to gain unauthorized access to ThinkAsia, or ADBI or our partner systems or networks; scrape, data extract or data mine, or any related activity, from ThinkAsia, or otherwise collect information about other ThinkAsia users without their consent; or submit or link to any content (including any name or User ID you use in ThinkAsia) that:

  • • infringes or violates the intellectual property or other rights of any person or entity;
  • • intentionally interferes with the operation of ThinkAsia;
  • • violates anyone’s privacy or publicity rights;
  • • breaches any duty of confidentiality that you owe to anyone;
  • • provides any nonpublic information about ADBI or any other company or person without authorization (including the names and contact information of our employees or ThinkAsia users);
  • • is, in our sole discretion vulgar, offensive, inappropriate, harassing, defamatory, abusive, lewd, pornographic, obscene, or otherwise objectionable; or that we reject for any other reason in our sole discretion;
  • • contains or installs any viruses, worms, bugs, Trojan horses, malware, or other code, files, or programs designed or having the capability to disrupt, damage, or limit the functionality of any software or hardware; or
  • • contains false or deceptive language, unsubstantiated or comparative claims regarding our or others’ products, advertising, commercial referrals, spam, chain letters, or any other solicitation, including solicitation of lawsuits.

Please remember that you may be providing content for an international audience. Things that do not seem abusive, obscene, or offensive to you might seem so to others. The users agree to bear all risks associated with using or relying upon content on ThinkAsia. In no event shall ThinkAsia or our partners, affiliates, officers, agents, and employees, have any liability hereunder to you for any losses or damages whatsoever, including but not limited to direct, indirect, special, incidental, punitive, or consequential damages, or damages based on lost profits, data or use, however, caused and, whether in contract, tort or under any other theory of liability, whether or not you have been advised of the possibility of such damages.

3.4 Style guide: Community partners are responsible for the content posted on ThinkAsia and can be posted in their house style, with the exception of ADB member names that it is requested be in accordance with ADB style guide. Handbook of Style and Usage | Asian Development Bank (adb.org).

3.5 Third-Party Links: ThinkAsia may contain links to third-party sites; such linked sites are not under our control, and ADBI is not responsible for the content of any linked site, or any link contained in a linked site. ADBI reserve the right to remove any links at any time. ADBI does not endorse the companies or products to which it links and reserves the right to note such on its web pages. If you decide to access any of the third-party sites linked, do so entirely at your own risk.

4. Privacy and Data Collection

4.1 Personal Information: ThinkAsia collects a user's name and email during the registration process. Any additional details provided, such as educational background, gender, affiliation, and others, are at the user's discretion.

4.2 Data Security: We take the security of your personal information seriously. Please review our Privacy Policy for more details on how we collect, use, and protect your information.

4.3 ADBI may track and analyze your use of ThinkAsia, including, but not limited to, data submitted, for the purposes of helping ADBI improve both ThinkAsia and your experience in using the platform and furthering our understanding of the use of ThinkAsia. ADBI may disclose such data about your use of ThinkAsia (“Usage Statistics”) to third parties for the purpose of assisting ADBI in such tracking or analysis, or where required by law.

6. Modification of Terms

No provision of these Terms shall be interpreted or applied in a manner, or to an extent, inconsistent with such immunities, exemptions, and privileges.

The Users agree to indemnify and hold ThinkAsia/ADBI and our partners, affiliates, officers, agents, and employees harmless from any claims, demands, liabilities, losses, damages, costs and expenses (including, without limitation, reasonable attorneys' fees) arising from: (i) your breach of these Terms of Use or (ii) any claim made by any third party arising out of content you submit to or post on ThinkAsia and your activity on ThinkAsia, including, but not limited to, your violation of these Terms or your violation of any rights of a third party.

These Terms of Use do not create a partnership, franchise, joint venture, agency, fiduciary or employment relationship between you and us. You may not assign your rights or obligations under these Terms of Use, whether by operation of law or otherwise, without our prior written consent.
